Being charged with any criminal or traffic offense can be a frightening experience. In addition to a record of a motor vehicle traffic violation, there are serious and long term collateral consequences to motor vehicle convictions, the most common can be the suspension of driving and registration privileges, the mandatory installation of interlock devices in DWI cases and of course, New Jersey Automobile Insurance Surcharges.

There are three kinds of “points” assessed in New Jersey:

– License points which can result in a suspension of your driving privileges for a period of time;

– State surcharge points which can require payments to the New Jersey Motor Vehicle Surcharge Unit each year for a term of years and;

– Insurance points assessed by your insurance carrier.

Failure to pay State surcharges can result in a suspension of your driver’s license. Surcharge points are assessed for driving while suspended, driving while unlicensed, and other traffic violations. Accumulation of 6 points or more in 3 years results in surcharges for several years. A DWI conviction results in surcharges of $1,000.00 a year for three years in addition to the fines and assessments imposed by the court.
